25. Declaratory and Injunctive Relief

  1. I find that the ENIAC is invalid and unenforceable and that plaintiff is entitled to a declaration to that effect.
  2. I find that plaintiff is entitled to an injunction restraining defendants from enforcing or attempting to enforce the monopoly created by the invalid ENIAC patent.
  3. I find that if the ENIAC is later declared valid, that defendants are entitled to an injunction against continued infringement by plaintiff.
